Application by City of Biloxi to fill Coastal Wetlands for creation of marsh, sand beach, and island habitat and breakwaters

PUBLIC NOTICE OF APPLICATION
FOR COASTAL WETLANDS PERMIT
AND WATER QUALITY CERTIFICATION

The City of Biloxi has filed an application requesting permission to conduct regulated activities under the provision of the Coastal Wetlands Protection Law Act, Title 49, Chapter 27, Mississippi Code of 1972.

The applicant is proposing to fill approximately 6.51 acres of Coastal Wetlands (unvegetated waterbottoms) for the creation of tidal emergent marsh and high marsh, island habitat, fill to eliminate a low spot, sand beach, and submerged and emergent breakwater structures. The proposed project is located near Cadet Street, Biloxi Bay, Biloxi, Harrison County, MS.

The applicant has requested a variance to: Miss. Admin. Code Title 22, Part 23, The Coastal Program, Chapter 8, 114.01 which states, “Permanent filling of coastal wetlands below the mean high tide line because of potential adverse and cumulative environmental impacts is not authorized.” The applicant justifies this request under Miss. Admin. Code Title 22, Part 23, The Coastal Program, Chapter 8, 118.04 by stating that the impacts on Coastal Wetlands would be no worse than if the requirements were followed.
