AND WATER QUALITY CERTIFICATION
The Jackson County Board of Supervisors has filed an application requesting permission to conduct regulated activities under the provision of the Coastal Wetlands Protection Law Act, Title 49, Chapter 27, Mississippi Code of 1972.
The applicant is proposing to dredge a man-made canal that drains into Old Fort Bayou near Vermont Avenue in Ocean Springs, hereafter referred to as Vermont Canal. The applicant will be required to request and justify a variance from Miss. Admin. Code Title 22, Part 23, Chapter 8, Section 117.01 which states, “Dredging or excavation of sensitive coastal wetlands is not authorized”, and Miss. Admin Code Title 22, Part 23, Chapter 8, Section 117.03 which states, “A minimum ten-foot (10-foot) buffer must be maintained between dredging/excavation and any wetlands.”
