Legal Notice – Notice of Derelict Vessel Proceedings

NOTICE OF DERELICT VESSEL PROCEEDINGS TO NGHIA VAN TRAN, VANNY TRAN
& ALL UNKNOWN PERSONS CLAIMING ANY INTEREST IN THE FOLLOWING VESSEL:

The Mississippi Department of Marine Resources (MDMR) has determined that the vessel described below constitutes a derelict vessel pursuant to Miss. Code Ann. §49-27-71.

You are hereby notified that the vessel must be removed from its current location no later than MONDAY, MARCH 31, 2023. You must submit a Removal Plan to the MDMR outlining your plan for removing the vessel from its current location no later than FRIDAY, MARCH 27, 2023.

The information contained in the attached guidelines must be included in the Removal Plan.
VESSEL DESCRIPTION: Name: “Capt Cannon”, a 40’, 1964 steel hull fishing vessel,
VESSEL LOCATION: Biloxi Dock & Ice, vessel found adrift in Biloxi Back Bay N 30*24.802 W88*52.905
COAST GUARD REGISTRATION: documentation number: 296250
VESSEL OWNER(S): NGHIA VAN TRAN, VANNY TRAN

Should the vessel not be removed by FRIDAY, MARCH 31, 2023, the MDMR will proceed with the prosecution of this matter making you a defendant seeking all costs of removal, which includes the recovery of expenses incurred as a result of, or incidental to, removal, storage, and restoration of affected lands, attorney’s fees, court costs, penalties and damages up to FIVE HUNDRED DOLLARS ($500.00) per day for every day the vessel was left derelict, beginning on the day the notice was posted on the vessel.
