WETLANDS PERMITTING
SUBMITTAL REQUIREMENTS

INFORMATION REQUIRED WHEN SUBMITTING YOUR APPLICATION

All applications require the submittal of at least one project diagram. This diagram should be clearly legible and include dimensions of all proposed impacts. The following lists give examples of project types and limitations. Below each list are instructions for what information should be included on your diagram. Your project may include elements from more than one list and you may need more than one diagram to show all of the required information.

Please collect all necessary documentation prior to starting a new application, failure to do so may result in a delay in processing your application.

MINOR PROJECTS
If your project meets the limitations below and is located in the USACE Mobile District, project verification can be issued by MDMR. For further details on these limitations and other conditions your project will need to meet, read the full General Permit Guidelines.

PROJECT LIMITATIONS

  • Piers & Boathouses: 2,000 square feet total
  • Boathouse length: 50 linear feet
  • Bulkheads: 500 linear feet
  • Riprap: No limit
  • Maintenance dredging: 2,500 cubic yards
  • New dredging: 1,000 cubic yards
  • Reconstruction of existing, previously permitted structures, even if outside these limits

DIAGRAMS FOR ABOVE IMPACTS SHOULD SHOW:

  • Dimensions of all proposed impacts
  • Dimensions of all existing structures
  • Property lines
  • Approximate shoreline
  • Presence of any marsh vegetation

*If your proposed project does not meet the limits above, you will also need to submit a cross-sectional diagram

OTHER PROJECTS

Projects not meeting the above limits for Minor Projects and any projects within the MS Sound or the Pearl River watershed (Vicksburg District) typically require separate authorizations from:

These projects may also require review for potential impacts to threatened, endangered, or special concern species by the:

Examples of such projects include:

  • Placement of any type of fill material into wetlands or waterbottoms including fill for
    • Residential subdivisions or developments
    • Commercial developments, such as shopping centers and industrial sites
    • Jetties, breakwaters, groins or similar
    • Artificial reefs, oyster reefs, or similar fish-attraction devices
    • Fill for marsh or living shoreline creation
  • New or expanded marinas
  • Utility line installation or maintenance

Some of these projects will require submittal of additional information such as:

For more information about these submittal requirements in non-tidal wetlands, contact the appropriate USACE district’s Regulatory office:

For tidal or tidally-influenced wetlands (waterbottoms, marshes, etc.), contact the MS Department of Marine Resources:

Federal project reviews furnished by US Fish and Wildlife Service – Mississippi Ecological Services office focus only on assessing project impacts to federally threatened or endangered species on a countywide basis.  To provide the state’s perspective and a more localized assessment, it is recommended that an additional review be performed by the Mississippi Department of Wildlife, Fisheries and Parks’ – Mississippi Natural Heritage Program. The Natural Heritage Program will review a proposed project for potential impacts to species known from its database that are listed as federal or state threatened, endangered or of special concern species. The official response would provide to the applicant: a list of these species found within a two-mile buffer of the project and an assessment of potential project impacts (if applicable) to those species and their habitats. The response will also recommend best management practices that may be implemented and maintained throughout the project to minimize any adverse impacts to these species.

The Mississippi Natural Heritage Program initiated a mandatory online project review application submission system in March 2019 for all project evaluations and reviews. To request a review, the applicant, or their agent, may only submit the project files using the online system. Requests are processed in the order in which they are received. Response time depends on the number of other requests being processed at the time the request is received; however, requests are usually completed within 14 business days. There is a processing fee of $45/quad associated with each project review. More information regarding natural heritage information requests can be found at mdwfp.com/museum/seek-study/natural-heritage-program/request-natural-heritage-information/.

A two-page tutorial on how to use this online system is provided at mdwfp.com/media/256525/mississippi-natural-heritage-program-web-app-for-environmental-review-requests.pdf.
